V\u1eady k\u00fd POA th\u1ebf n\u00e0o cho \u0111\u00fang?<\/p>\n<h2>1. Khi n\u00e0o c\u1ea7n POA?<\/h2>\n<p>POA b\u1eaft bu\u1ed9c v\u1edbi <b>t\u1edd khai ch\u00ednh th\u1ee9c (formal entry)<\/b> v\u00e0 t\u1edd khai phi ch\u00ednh th\u1ee9c thu\u1ed9c di\u1ec7n h\u1ea1n ch\u1ebf. \u0110\u1ea1i l\u00fd h\u1ea3i quan ph\u1ea3i c\u00f3 POA <b>tr\u01b0\u1edbc khi<\/b> l\u1eadp t\u1edd khai, n\u00ean h\u00e3y k\u00fd s\u1edbm, t\u1ed1t nh\u1ea5t tr\u01b0\u1edbc khi t\u00e0u ch\u1ea1y. Khi POA \u0111\u01b0\u1ee3c k\u00fd, c\u00f4ng ty k\u00fd tr\u1edf th\u00e0nh <b>Importer of Record (IOR)<\/b>, c\u00f2n \u0111\u1ea1i l\u00fd h\u1ea3i quan l\u00e0 ng\u01b0\u1eddi \u0111\u1ea1i di\u1ec7n l\u00e0m vi\u1ec7c v\u1edbi CBP.<\/p>\n<h2>2. Quy \u0111\u1ecbnh m\u1edbi: ph\u1ea3i k\u00fd tr\u1ef1c ti\u1ebfp v\u1edbi kh\u00e1ch h\u00e0ng<\/h2>\n<p>Theo quy \u0111\u1ecbnh hi\u1ec7n \u0111\u1ea1i h\u00f3a ngh\u1ec1 \u0111\u1ea1i l\u00fd h\u1ea3i quan (19 CFR 111.36(c)(3)), \u00e1p d\u1ee5ng cho POA k\u00fd t\u1eeb 19\/12\/2022 v\u00e0 to\u00e0n b\u1ed9 POA \u0111ang d\u00f9ng t\u1eeb 17\/02\/2023:<\/p>\n<ul><li>POA ph\u1ea3i \u0111\u01b0\u1ee3c k\u00fd <b>tr\u1ef1c ti\u1ebfp gi\u1eefa \u0111\u1ea1i l\u00fd h\u1ea3i quan v\u00e0 nh\u00e0 nh\u1eadp kh\u1ea9u<\/b>, kh\u00f4ng qua c\u00f4ng ty giao nh\u1eadn hay b\u00ean th\u1ee9 ba kh\u00f4ng c\u00f3 gi\u1ea5y ph\u00e9p.<\/li>\n<li>POA do c\u00f4ng ty giao nh\u1eadn k\u00fd thay kh\u00e1ch ph\u1ea3i \u0111\u01b0\u1ee3c k\u00fd l\u1ea1i.<\/li>\n<li>POA kh\u00e1ch \u0111\u00e3 k\u00fd nh\u01b0ng kh\u00f4ng c\u00f3 li\u00ean h\u1ec7 tr\u1ef1c ti\u1ebfp: \u0111\u1ea1i l\u00fd ph\u1ea3i li\u00ean h\u1ec7 tr\u1ef1c ti\u1ebfp \u0111\u1ec3 x\u00e1c nh\u1eadn l\u1ea1i ho\u1eb7c k\u00fd m\u1edbi.<\/li>\n<li>B\u00ean th\u1ee9 ba v\u1eabn \u0111\u01b0\u1ee3c h\u1ed7 tr\u1ee3: d\u1ecbch thu\u1eadt, t\u01b0 v\u1ea5n \u0111i\u1ec1u kho\u1ea3n, chuy\u1ec3n ph\u00e1t POA. Nh\u01b0ng kh\u00f4ng \u0111\u01b0\u1ee3c \u0111\u1ee9ng ch\u1eafn gi\u1eefa \u0111\u1ea1i l\u00fd v\u00e0 kh\u00e1ch.<\/li>\n<li>\u0110\u1ea1i l\u00fd A c\u00f3 th\u1ec3 giao m\u1ed9t ph\u1ea7n vi\u1ec7c cho \u0111\u1ea1i l\u00fd B n\u1ebfu kh\u00e1ch cho ph\u00e9p.<\/li><\/ul>\n<h2>3. &#8220;Nghi\u1ec7p v\u1ee5 h\u1ea3i quan&#8221; g\u1ed3m nh\u1eefng g\u00ec?<\/h2>\n<p>Theo 19 CFR 111.1: c\u00e1c giao d\u1ecbch v\u1edbi CBP v\u1ec1 nh\u1eadp c\u1ea3nh v\u00e0 kh\u1ea3 n\u0103ng \u0111\u01b0\u1ee3c nh\u1eadp kh\u1ea9u c\u1ee7a h\u00e0ng h\u00f3a, ph\u00e2n lo\u1ea1i, x\u00e1c \u0111\u1ecbnh tr\u1ecb gi\u00e1, n\u1ed9p thu\u1ebf ph\u00ed, ho\u00e0n thu\u1ebf, k\u1ec3 c\u1ea3 vi\u1ec7c chu\u1ea9n b\u1ecb v\u00e0 truy\u1ec1n ch\u1ee9ng t\u1eeb. Kh\u00f4ng bao g\u1ed3m vi\u1ec7c ch\u1ec9 truy\u1ec1n d\u1eef li\u1ec7u \u0111\u01a1n thu\u1ea7n, hay ho\u1ea1t \u0111\u1ed9ng tu\u00e2n th\u1ee7 n\u1ed9i b\u1ed9 c\u1ee7a doanh nghi\u1ec7p.<\/p>\n<div class=\"box\"><b>Ai ch\u1ecbu tr\u00e1ch nhi\u1ec7m cu\u1ed1i c\u00f9ng?<\/b> \u0110\u1ea1i l\u00fd h\u1ea3i quan ph\u1ea3i gi\u00e1m s\u00e1t v\u00e0 ki\u1ec3m so\u00e1t h\u1ee3p l\u00fd \u0111\u1ec3 truy\u1ec1n d\u1eef li\u1ec7u ch\u00ednh x\u00e1c, k\u1ecbp th\u1eddi. Nh\u01b0ng <b>nh\u00e0 nh\u1eadp kh\u1ea9u<\/b> m\u1edbi l\u00e0 ng\u01b0\u1eddi ch\u1ecbu tr\u00e1ch nhi\u1ec7m cu\u1ed1i c\u00f9ng: ph\u1ea3i th\u1eadn tr\u1ecdng h\u1ee3p l\u00fd (reasonable care) khi cung c\u1ea5p th\u00f4ng tin, v\u00e0 kh\u00f4ng th\u1ec3 &#8220;\u0111\u1ea9y&#8221; tr\u00e1ch nhi\u1ec7m cho \u0111\u1ea1i l\u00fd.<\/div>\n<h2>4.
